The decision of the Lok Sabha Speaker to recognize Shewale has been challenged in the latest petition. Shiv SenaFloor leader at the behest of Shinde faction.
The Uddhav group termed the speaker’s action as “illegal” and “arbitrary” and alleged that the Shiv Sena leader and its chief whip in the Lok Sabha were unilaterally removed.
“The Speaker made the impugned changes in the posts of Leader and Chief Whip without following the basic rules of natural justice or even without seeking explanation from the Shiv Sena political party or the petitioners herein, notwithstanding the explicit request in this regard, informed him, submitted the petition.
The petition said the names of Vinayak Raut and Rajan Vichare as leader and chief whip of Shiv Sena in Lok Sabha, respectively, were repeated and communicated to Birla.
The Speaker, however, approved the names proposed by the Shinde faction, it said.
“As such, the action of Respondent No. 1 is clearly and clearly arbitrary and outright violative of the scheme envisaged under the Tenth Schedule to the Constitution, Article 14 thereof,” it submitted.
Shinde, along with 12 of the Shiv Sena’s 19 Lok Sabha members, had named Shewale as the party’s leader and Bhavna Gawle as the chief whip in the Lok Sabha.
Earlier Vinayak Bhaurao Raut and Rajan Vichare were leaders of the party in Lok Sabha and chief whip of Shiv Sena.
On 26 July, the top court had agreed to hear another fresh plea for recognition as the real Shiv Sena by the Shinde-led group against the Election Commission proceedings by the Thackeray faction on August 1.
Earlier, the Uddhav-led Shiv Sena faction had also moved the apex court to stay the Election Commission proceedings initiated by the Eknath Shinde-led Shiv Sena faction, seeking control over the party’s ‘Dhanush’. There was a demand to be recognized as the “real” Shiv Sena. and arrow symbol.
A three-member bench of Chief Justice NV Ramana and Justices Krishna Murari and Hima Kohli will hear the petition on August 1.
Thackeray-faction general secretary Subhash Desai in an application requested the Supreme Court to make the Election Commission a party in six pending cross-petitions filed by both the Shiv Sena groups over issues related to the disqualification of MLAs from both sides, Shinde said.
